Terms and Conditions of Sale and Transfer
 

Item for sale (hereinafter referred to as “Item”):

 

  • Pontiac LeMans Sport convertible (VIN 237671P134973)

  • Built-in 407 cu in V8 engine with variable valve timing in accordance with U.S. Patent 7,171,930 

  • Additional set of Vari-Lift rockers

  • 1 set of Edelbrock 87cc heads for Pontiac

  • The original patent certificate issued by the United States Patent and Trademark Office (USPTO)

Currency

The currency for offers and sales is CHF (Swiss franc).

 

Deadline for Submitting Bids
The deadline for submission is set by the seller and will be published on the bid form page.
The seller reserves the right to extend or shorten the submission deadline.


Binding Nature

Bids are legally binding and you agree to terms when you submit a bid.

Publication of Bids

The five highest bids will be published on the website until the deadline for submission. The nicknames of the five highest bidders, the date of receipt, and the amounts bid will be published in a list on the website and updated regularly. The names, addresses, and contact details of the bidders will not be published.

Viewings and Test Drives

Participants will have the opportunity to view the vehicle in person and take it for a test drive. Viewing appointments will be arranged by mutual agreement.

Purchase Agreement

Within a period of seven working daysThe buyer signs the written purchase agreement and returns the signed agreement to the seller.

Payment and Vehicle Release Terms (You can choose from 3 options)

To ensure a smooth and secure transaction for both of us, please find our official payment and vehicle release terms below:

Option 1: Cash Payment Upon Personal Pickup by the Buyer 
Please note: The vehicle MUST be picked up in person by the buyer (name listed in the purchase agreement). Pickup by representatives will not be accepted.

Option 2: The Buyer Arranges Shipping

  1. Payment Method: Payment must be made in full via International Wire Transfer (SWIFT) to our Swiss bank account or via the certified escrow service Escrow.com (buyer covers escrow fees).

  2. No Alternative Payments: Please note that we strictly do not accept checks, certified checks, or PayPal for vehicle purchases due to international banking regulations.

  3. Vehicle Release: The vehicle, along with all original registration documents and titles, will be released to your shipping company only after the funds have been fully credited to our bank account and verified by our bank.

  4. Pickup Proof: The shipping driver must provide a signed pickup confirmation (e.g., CMR or Bill of Lading) upon loading the vehicle.

Once you confirm your preferred method (Wire Transfer or Escrow.com), we will provide you with the formal invoice and the necessary banking details / escrow link.

Option 3: The Seller Arranges Shipping

Since we will be handling the international shipping logistics from Switzerland to the US, here is how we will securely structure the payment and delivery:

  1. Payment Method: Payment must be made via International Wire Transfer (SWIFT) to our Swiss bank account or via Escrow.com.

  2. Deposit & Shipping: A deposit of 50% of the sales price is required to book the shipping company and initiate the export customs process in Switzerland.

  3. Final Payment: The remaining balance must be paid once the vehicle is loaded onto the ship.

  4. Document Release: We will hold the original Bill of Lading (B/L) and the original Swiss vehicle documents in our possession. As soon as the final payment is fully credited and cleared by our bank, we will send all original documents to you via express courier (DHL/FedEx) so you can clear customs and collect the vehicle at the US port.

Please let us know if you would like to proceed with a direct Wire Transfer or via Escrow.com, and we will prepare the sales contract and invoice.

Deadline for Collection of the Vehicle

Upon request, the vehicle can be stored free of charge at the seller's premises (underground parking space) until collection. However, the vehicle must be collected no later than 3 months after the date of conclusion of the contract.

Right of Rescission

Once the purchase agreement has been signed, the purchase is legally binding and cannot be revoked. In the event of non-fulfillment of the purchase agreement, the seller reserves the right, based on Art. 214 of the Swiss Code of Obligations, to sell the item and to claim the amount of the loss from the party responsible for the damage through legal channels, based on Art. 215 of the Swiss Code of Obligations.
